Defective Airbags

Literally millions of automobiles in the United States – a variety of makes and models – are being recalled for potentially defective air bags after a number of serious injuries and fatalities. In November, the National Highway Traffic Safety Administration (NHTSA) imposed the largest civil penalty in the agency’s history on the Takata Corporation, the manufacturer of the air bags. Takata is being fined $200 million for violations of the Motor Vehicle Safety Act. Also for the first time, the NHTSA is exercising its authority to prioritize and expedite repairs on millions of affected vehicles so that the greatest safety risks are addressed first. If you or someone you love has been injured or is injured in the future by an exploding air bag – or because of any other defective auto part – speak at once about your legal rights and options with an experienced Dallas product liability attorney.

In announcing the measures, Secretary of Transportation Anthony Foxx made the government’s position clear. “For years, Takata has built and sold defective products, refused to acknowledge the defect, and failed to provide full information to NHTSA, its customers, or the public. The result of that delay and denial has harmed scores of consumers and caused the largest, most complex safety recall in history. Today’s actions represent aggressive use of NHTSA’s authority to clean up these problems and protect public safety.”

The list of recalled makes and models is long, and it includes U.S., Japanese, and European automakers. If you have not received a recall notice, you can look up your vehicle at the NHTSA website or contact your auto dealership. If your car, truck, or SUV has been recalled – for an air bag or any other reason – take it to a dealer for a repair or a replacement immediately. If you are injured by an exploding air bag or by any other defective auto part in the Dallas-Fort Worth area, arrange as quickly as possible to discuss your injuries – and a possible product liability lawsuit – with an experienced Dallas product liability attorney.
